If the amount you are under the cap is less than the amount of the MLE you get the MLE. You can be under the cap and still have the MLE.
Etan Thomas has a cap hold equal to the tender offer for him which is about $3mil.
So if the MLE is $5mil and we are $4.9mil under the cap and Etan signs with another team then we technically could have $7.9mil under the cap.
This is dependant on what the cap hold for Thomas is. It could be more than $3mil as well, so the Times article could be right.
I doubt it is though, but it is not that big of a deal.
