If the victim dies, the facts we have support a First Degree Manslaughter Charge. See NY Penal Code Section 125.20 ("A person is guilty of manslaughter in the first degree when . . . [w]ith intent to cause serious physical injury to another person, he causes the death of such person or of a third person"). There is even a possibility they could charge him with second degree murder. See Section 125.25 ("A person is guilty of murder in the second degree when . . . [u]nder circumstances evincing a depraved indifference to human life, he recklessly engages in conduct which creates a grave risk of death to another person, and thereby causes the death of another person").
If the victim survives, he is definitely facing a charge of 1st Degree Assault. See 120.10 ("A person is guilty of assault in the first degree when . . . [u]nder circumstances evincing a depraved indifference to human life, he recklessly engages in conduct which creates a grave risk of death to another person, and thereby causes serious physical injury to another person").
(2) Would the United States deport Minja if he was convicted?
Boisy is absolutely right. If convicted of any of those offenses, the US would almost certainly deport Minja. See 8 U.S.C. 1227(a)(2) (providing that aliens "convicted of a crime for which a sentence of one year or longer may be imposed" are deportable).

Believe pressconnects.com said they already charged him with 2nd degree felony assault. Here's hoping Steinhauer pulls out of this and recovers.
ps- anyone who blames this on Walker OR Broadus is an idiot.

Re: minja in trouble?
Any update on the victim? I'm assuming it's good news that the situation hasn't turned for the worse.....every day is critical.

Re: minja in trouble?
Assault in the 2d Degree is a safer bet from the People's perspective. I do think, on the facts we have, an aggressive prosecutor might have brought 1st Degree Assault charges.

Re: minja in trouble?
Is this strange wording or am I as simple as most of you think I am?

Before the incident coaches had not yet asked Kovacevic to play next season, Glover said. He was not offered an athletic scholarship, which is renewed on an annual basis.
|
I didn't realize coaches went around asking their returning players to play the next season.
It goes from "...had not yet asked Kovacevic to play next season" to "He was not offered an athletic scholarship, which is renewed on an annual basis."
Evidently at the time of the incident Minja hadn't been told by the coaching staff that he wouldn't be back.
Very shady wording in my simple opinion.

Re: minja in trouble?
Thanks for the update. I'm sorry to hear that Steinhauer is listed as "clinging to life."

If you did you would probably be correct both times.

It sounds like the coaching staff was still not sure whether they wanted him back at the time of this incident, and that his being thrown in jail helped them make that conclusion. I really don't see what the problem is with admitting he was on the team, if he was, technically. It's not like he was thrown in jail before and the school kept ignoring it to keep him on the team. Sure, he might have a "history" of problems, but if it's not official and documented, then the team or the school doesn't really have this image problem. They kicked him off the team after the first time, as far as we know (right?), that he got into trouble with the law and I think that's all that SUNY-B needs to show.
What are NY's hate-crime laws? I could look them up on Lexis, but I'm too lazy. Can Minja get more time because the fight occurred because the victim was with gay people (I'd assume he was defending them or sticking up for them or something).

BU's starting hockey goalie just had his athletic scholarship taken away and was not asked to come back to the team next year. Unless they are kicked off the team for disciplinary reasons, I think you have to continue to give players a scholarship in some shape or form. Ibrahim Konate on BU won't be returning next year to our squad but still remains on (academic) scholarship.

Re: minja in trouble?
Untrue; Scholarships are renewable. You only have to honor a year at a time. It is not a 4 year contract, rather a one-year renewable contract.
You can revoke for any reason. PR is why you wouldn't make it a practice not to renew.

Re: minja in trouble?
yeah you're right. I just vicariously assumed schools had such a rule. You generally see athletes remain on some sort of scholarship even if their athletic scholarship is removed. I think this is to hold some recruiting credibility, because I don't think that any athlete would want to come to a school thinking there's an outside shot of them losing their funding if they have a medical injury or some kind of accident.
