And since the prosecutor chooses what cases to present to the grand jury, the Dez Wells case must have been presented for a reason other than trying to have Wells indicted, i.e., criminally charged. And flap, grand jury proceedings take place in court, therefore they are "court cases". Just not a trial to determine whether the Defendant is not guilty. The prosecutor believed Wells innocent so there is no legitimate reason to involve a grand jury.

But, because he wants Xavier to continue to be wildly successful in their men's basketball program he takes this to the grandy jury so he can sway public opinion against the Xavier administration and get Dez back on the team.

Where do these Dayton fans come up with this delusional stuff? I hope you weren't educated at UD.
Actually that is your spin on my theory. My theory is the prosecutor is abusing the system whether because he is a fan, wishes to bolster his political standing in Cincinnati, or both. You have yet to come up with a rational explanation why a prosecutor would involve a person he characterized as innocent in a criminal proceeding. He clearly did not want the grand jury to indict Wells. I'm sorry you did not learn in your education about what a grand jury is and how it functions. Maybe you could follow my argument then. I've talked with other attorneys and they agree there was some other motivation other than prosecutorial intent behind presenting this case to a grand jury.

It is sad rather than educating yourself you take great glee in wallowing in your ignorance and calling others names. I have the feeling we are going to increasingly see the ugly side of these X fans emerge this upcoming season when X struggles. Many of them will be UC fans again by mid-season.

Re: Dez is Back

I think that with high profile cases, especially those that involve sex offenses, the prosecutor would catch all sorts of heat if it was not taken to the grand jury.

SSSSHHHHHH.

Dunk thinks he's bringing enlightening judicial protocol to this board. It's the off season. Let him have his moment.

Dez Wells Will Visit Ohio State, According To Telep Report (SB Nation - August 31, 2012)
Sophomore shooting guard Dez Wells will visit Ohio State in the near future.

Aug 31, 2012
- Sophomore shooting guard Dezmine Wells will visit Ohio State, Memphis, Maryland and Oregon over the Labor Day weekend and is expected to make his decision on a new school fairly soon, according to a report by Dave Telep of ESPN.

Wells was expelled from Xavier on August 21st due to "a serious violation of the Code of Student Conduct" related to allegations of sexual assault.

Dez Wells Taking Recruiting Tour (ESPN - August 31, 2012)
Dezmine Wells, the recently expelled Xavier forward who began a recruiting tour Thursday at Kentucky and continued it Friday at Memphis, will decide on a destination by Tuesday from a short list that includes Maryland and Oregon, a source told ESPN.com's Dave Telep.

Wells had added the Ducks and Buckeyes as possible considerations Friday morning, the source told Telep, before Ohio State decided against bringing Wells in.

Kentucky was dropped from the candidates after an academic deadline passed Thursday night with Wells still unready to commit.

From Memphis, Wells will leave Saturday for Maryland before going to Oregon for visits that last five to six hours.

. . . or far too toxic - if you can imagine that - but quite possibly without any justifiable reason:

Dez Wells Rules Out UK as Possible Transfer Destination (Bleacher Report - September 1, 2012)
The university and Coach Calipari may have dodged a PR headache due to the sexual assault charge that was recently thrown out against the freshman.

Fair or not, a charge like that tends to have lasting ramifications against someone's reputation, even if he is completely innocent.

And even if the charges were false (which seems more and more to be the case as details about the incident emerge), the particulars of the situation that got Wells into all of this are still pretty unsavory.

Looks like he'll play this year. Maryland, Memphis or Oregon. Turned down UK due to no schollie immediately available. He'll get a waiver.

That would add a little chutzpah to the Memphis v Xavier game.

Wrong again. Have you ever served on a Grand Jury? I have. It was held in a community service room @ the Library due to a prior committment of the county's grand jury room. No Judge. No Defense Atty. Just the Prosecutor presenting the facts of the case. Same result. We refused to indict. You could have one in a barn in Dayton.

You should try voting once in a while and you might get called.

When Dez Wells eventualy begins his career in the NBA, look for Xavier University to erect a life-size photo of Dez in his Musketeers' uniform on the "Former Xavier Players in the NBA" wall in Cintas Center.

Are you sure she consented to everything he did? I thought that was the crux of the problem.

These two things don't go together. One invalidates the other.

Edit: No comment on the Dez situation, just stating policy.
