anyone here ever gotten a DUI/DWI?

I'm not going to get in to detail because I have not offically been charged with anything yet but I was stopped at a checkpoint last night and may be charged with a DUI depending on the lab results. I only had I pint of lager and blew a .011.

So does anyone here have a DUI or more than one?

I'm not gonna mention any names but R-Star prolly has to have some close calls at the least.

How is a .011 enough to get you in trouble? A .08 used to be the limit up here. Switched to .05 recently.

Anyways, never got a DUI, but one year in my early 20's I had 3 24 hour suspensions which is basically a nice way of the cop saying I could give you a DUI right now but am letting you off the hook.

(This is not legal advice/I'm not your lawyer) I would recommend talking to the City attorney of the municipality that is charging you in an attempt to reduce the charges. Sometimes something like a .011 can be reduced to something lower that won't stay on your record. Particularly if you can cast some doubt on the results of the test or whether or not they had probable cause to administer it. Were you driving erratically?

My brother beat a DUI because the officer that arrested him was a terrible liar. And police dishonesty isn't some rare event, but your best hope is certainly that the officer exaggerates everything to a degree that holes are easily poked in his testimony.

Doesn't make sense to me...

What state are you in? ...and why in the world did you agree to a blood test? If you cruise up to a checkpoint, they are looking for 3 things usually.... Seatbelts, valid DL/insurance, and to see if you're drunk... Every once in awhile they catch someone with a b.s. warrant...

How does one end up getting blood tested? And if one was subject to a blood test, how are you at home waiting for results? The only time they draw blood, is after an accident or you fail the field sobriety test... At that point, they can hold you for 24hrs without charging you... At that point, you are either charged or released... I've never, ever heard of them drawing blood and telling the person, "ok, go home and we will call you in a few days."

Live in PA, took 4 soberity tests and then they told me I was being charged with dui, where I was handcuffed and taken to the hospital. I think the charges are pending untill they get the results back from the lab.

If you blow more than .08 many police departments order blood tests to confirm the results. Given the inaccuracy of the breathalyzer tests the "blood test for confirmation" requirement is a good one. They did that to my brother, and the blood tests showed .07, which got the charge reduced from OWI to OUI. But he still beat it because the arresting officer didn't know what the various field sobriety tests measure, and in his manufactured testimony claimed that my brother only passed the one test that that he failed (but it's the one test that no one can actually pass).
