i heard a few days ago that he was just charged with wreckless driving because he used the shoulder to get off the freeway during an accident and the cops pulled him over but he passed the sobriety test. i guess not though.

They said the gave Payton a chemical test and then released him so it is entirely possible that he wasn't under the influence. Field Sobriety Tests are notoriously inaccurate and often give positive IDs even though the suspect isn't over the legal limit.
