Officially, the university gets to decide, and they officially decided that he could call himself a professor. You may not like it, but they get to decide whatever they like about titles.

I am a constitutional law professor = formal title. How else are you going to interpret it? He didn't say he served as a professor or was regarded as a professor. Would a person claim he was a school teacher when his formal title was assistant?

I often say I'm a businessman when I don't want to explain in gory detail, but my card does not actually say "Businessman" below my name. Perhaps I've been dishonest?
Most people, in fact, don't describe what they do via recital of their formal title.

Well, there's a huge gap between "constitutional law professor" and lecturer. That was his actual term "constitutional law professor." Which term has the gory details again? He could have said he taught constitutional law and be done with it. Instead, he wanted the audience to be impressed.
