Woman wins $2.1 mil for fault at RG
One of my fellow employees at the RG (who also works at PGE) park told me that this woman was intoxicated at the time when she fell off the 300 level smoking terrace which faces NE Wheeler Ave. This co-worker had to testify in court. I have seen these counters/shelves and they are certainly not short. They are a good 4.5 feet off the ground. Its not a bench.

Not trying to be mean, but I have never seen anyone else try to attempt to sit on the ledge.
She lacked common sense that night by being drunk, bad judgement, and should face the responsibility that she faced that night for being in the state that she was in.
I am glad that she was only awarded half from her original lawsuit. It pays for being stupid.

Damages were $4M and she got half, $2M, because it was half her fault. But hospital bills have been $1M. So she's a millionaire with what's left. I guess the jury estimated her future medical bills will eat up the other $1M. But they won't, since the initial $1M was caused by 3 months in a hospital and 6 in a nursing home. So yes, she's a millionaire. Many people would go through that in order to come out ahead a million.

I don't care what kind of protection was needed, that seems like a no brainer here. Don't sit on the ledge of a balcony thats several feet above the ground.

Lawyers might get 50 and then 40 to taxes and she doesn't even cover her hospital bills. I have looked at that ledge after that happened... and she was freaking nuts to do that even if sober. That story makes it look like that ledge was sitting height... but it was taller than that... she had to purposely climb up there. I didn't walk up to it... but wasn't it like arm pit height so you could see over but not sit on it? Did they ever change this or did they just put up a bunch of warning signs.

I sure wouldn't. With a shattered pelvis, she'll probably be physically compromised and in pain the rest of her life.
That said, from what I'm reading here I agree with others that it doesn't seem right that she was paid off because of an accident that was the result of her own stupidity.

Actually, that one McDonalds was at fault for. They had the coffee at a temperature that was unsafe, and they knew it. The hotter the water was, the more coffee they could get out of the grounds. So they had the coffee at a temperature that would cause 3rd degree burns, when normally coffee is never that hot.
