Trade Kicker question

OK, this issue came into my head after Elton Brand signed an offer sheet with Miami. The deal was for Max money, but supposedly also included a trade kicker. So, if he did get traded, Brand would make more than the Max amount.

I thought that a trade kicker could only take a contract up to the Max amount, and not over and above the Max amount.

Can anyone shed any light on this issue? Thanks.

It would be possible that at some point during the contract, his salary would be less than the maximum salary for someone with his years of experience. At that point, the trade kicker would not be superfluous.
