Samsung to pay Apple over $1 Billion in Damages

(CNN) -- A federal jury in California on Friday recommended that Apple be awarded more than $1 billion in damages after finding Samsung was guilty of "willful" violations of a number of Apple's patents in the creation of its own mobile products.

The jury did not recommend awarding Samsung any money in its counterclaims that Apple had violated some of its patents. The judge and lawyers from both Apple and Samsung continued to discuss the jury forms late Friday afternoon.

"This is a huge win for Apple," Mark Lemley, a Stanford law professor, said over e-mail. "$1,051,855,000 is just large enough to make it the largest surviving patent verdict in history."

In aftermarket trading, Apple stock jumped more than $12 a share, to more than $675 a share.

Samsung said the verdict should be viewed "as a loss for the American consumer."

"It will lead to fewer choices, less innovation, and potentially higher prices," the company said in a written statement. "It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies.

"Consumers have the right to choices, and they know what they are buying when they purchase Samsung products. This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple's claims. Samsung will continue to innovate and offer choices for the consumer."

Apple praised the court for "sending a loud and clear message that stealing isn't right."

How many lifetimes before they get this money? All Samsung has to do is raise the prices they charge Apple for hardware and they'll make it all back. When you actually read what they claim Apple is stealing from them it's pretty idiotic. 'the look and feel' of an iPhone. Really?

If someone had copied 'the look and feel' of a post-it note prior to the 20 years allowed for Post-It to collect earnings, it would have ended in a lawsuit over the same thing. Apple has the buying power to buy from where-ever they want, if Samsung wants to lost Apple's business completely that's their decision.

The Android OS does not naturally look exactly like the iOS. You have to do some work to make that happen. The argument was that Samsung was trying to fool customers into buying their products by making even the OS environment look like the iPhone/iPad. They didn't do themselves any favours with the jury when they justified their way above industry average return rate by claiming that the problem wasn't people figuring out that they'd bought an inferior product but that the hardware was really junk and that's why they had such a high return rate.

That really isn't true. You can't get this sort of hardware from the Lowes. These sorts of fabrication facilities cost several billion dollars to build and there is a limited amount of capacity in the world. Then you have to plan all of it years in advance. You can not build an iPhone without Samsung.

I'm sure Apple can find another supplier that would jump at the bit regardless of the cost. Hell, they could even make it themselves if they wanted to. They have the capital and exemplified by this $2.65/share dividend last week, they don't know what to do with it. So they pay Samsung an increase (while Samsung tries to scoot around price gauging) and Apple starts to develop their own facilities.

This is really a non-story for a company as big as apple.

It actually can really damage their supply chain for the short and long term. samsung dominates the cell phone processor industry. Apple must be getting ready to switch to intel mobile processors otherwise it makes no sense to sue the company that supplies your entire phone.

Memory is nothing. You can get that easily. That isn't what is being discussed. That's not even a significant part of the cost of a phone.
