Question on that protected NY draft pick

I know that NY owes a protected draft pick to Utah, due before 2010 that is top 22 protected in 2009

my question is:

If the Knicks (against overwhelming odds) won't make the playoffs this year but end up with bad lottery pick, do they automaticly keep the pick or can they choose to give it to Utah because they already know they won't make the playoffs in 2010 and will have a better chance to get a quality player then?

Oh god.. this situation is such a mess.

I think the pick is top-something protected up until 2010 when it is not protected at all. So, I believe what that means is that in order for Utah to get the pick this season (if my understanding is correct) then NY would have to finish better than 8th in the NBA.. which at this rate won't happen.

So, basically, next year we get whatever first-round pick they'd normally get, entirely unprotected.

At least that's how I understood it.

so if the Jazz get the pick in 2010 it will be unprotected

but will the Knicks be able to give the pick to the Jazz this year if they want to?
they will most likely keep the pick this year anyway; so let's just hope they screw up in 09/10 so we end up with a decent pick

If they set it to where it's protected this yr and unprotected next yr, they can't choose to give it to Utah if they want to. Not unless they made it clear in the beginning.

sorry if my question was a little confused but you most likely noticed, English is not my native languge

but screw this draft/salary cap system, Europeans will never really get into it
